Court order mandates undocumented immigrants to register and carry legal documents


In a recent court ruling, U.S. District Court Judge Trevor Neil McFadden of the District of Columbia rejected the request from advocacy groups to pause the requirement for millions of immigrants without legal authorization to register with the U.S. Department of Homeland Security. As of Friday, these immigrants are now required to register and carry documentation proving their registration or face potential prison sentences or hefty fines.

DHS Secretary Kristi Noem applauded the court’s decision, stating that those in the country illegally should leave now to avoid consequences. The Migration Policy Institute estimates that between 2.2 million and 3.2 million immigrants will be affected by this new requirement, which is seen as a tool for the Trump administration to carry out mass deportations.

Under the new rule, immigrants aged 14 and older must carry registration documents received after submitting fingerprints and biometric information through an online application. While the advocacy groups raised concerns about proper rulemaking procedures and the potential for racial profiling and targeting of U.S. citizens, the court ruled in favor of the administration.

The registration requirement is authorized by the Alien Registration Act of 1940 and is reminiscent of the National Security Entry-Exit Registration System implemented after 9/11. This requirement applies to immigrants who entered the U.S. without legal authority and Canadian visitors staying more than 30 days, excluding certain visa holders and those in removal proceedings.
