Fulton County Judge to Decide on Subpoena Authority in Fani Willis Case

A significant ruling is anticipated from a Fulton County judge in the upcoming weeks regarding the subpoena powers of a state Senate investigations committee, which seeks to compel District Attorney Fani Willis to testify. This legal dispute arose after Willis declined to appear before the Senate Special Committee on Investigations, which formed to examine alleged misconduct related to her handling of the high-profile investigation into former President Donald Trump and 18 associates, who face racketeering charges related to efforts to overturn the 2020 presidential election results in Georgia.

At a recent hearing, Willis’s attorney, former Georgia Governor Roy Barnes, argued that Georgia law requires both chambers of the General Assembly to agree on joint resolutions or statutes granting subpoena powers to ethics committees. He emphasized that allowing one chamber to unilaterally issue subpoenas could set a dangerous precedent, potentially undermining the separation of powers between legislative bodies.

Barnes also contended that the committee’s expansive document requests and planned intrusive questioning exceeded their authority. Committee attorney Josh Belinfante, however, stated that the Georgia Supreme Court grants the legislature broad powers to issue subpoenas, stressing that the committee’s work is focused on evaluating the need for potential reforms in district attorney practices.

This controversy follows revelations about Willis’s previous romantic relationship with special prosecutor Nathan Wade, prompting GOP lawmakers to scrutinize her conduct more closely. The special Senate committee is expected to dissolve before the new legislative session in January, amid ongoing debates about budgetary constraints on hiring special counsel for the district attorney’s office.
