Trump’s Second Term: Key Choices on Reproductive Rights
As President-elect Donald Trump prepares for his second term, significant decisions loom regarding access to contraception and abortion. While Trump cannot unilaterally enact nationwide abortion laws, his cabinet appointments will heavily influence reproductive rights across the nation.
During his first term, Trump implemented restrictions on healthcare organizations providing abortion services, leading to a considerable withdrawal of providers from the Title X family planning program, which assists low-income individuals. Alina Salganicoff from KFF noted that this policy adversely affected about a quarter of eligible healthcare providers reliant on approximately $300 million allocated to Title X.
Another critical decision facing Trump concerns the bipartisan guidance under the Emergency Medical Treatment and Labor Act (EMTALA), protecting healthcare providers performing abortions in emergencies affecting women’s health. This issue is central to ongoing legal disputes, particularly between the Biden administration and the state of Idaho, and any reversal on this guidance could drastically impact access to emergency care for women.
Medication abortion, which comprises around 63% of abortions nationwide, also may come under scrutiny. The Trump administration’s approach to FDA prescribing guidelines for medication abortion could alter the availability of this service, particularly as states impose restrictions on access.
Trump’s administration may also choose to revisit enforcement of the Comstock Act, which historically restricted mailing contraceptives and could now threaten access to abortion medications, further complicating the landscape for reproductive rights.
