Fulton judge overturns Georgia state election board rules in sweeping decision • Georgia Recorder

In a significant legal victory, Fulton County Superior Court Judge Thomas A Cox Jr. overturned several controversial Georgia State Election Board rules that were set to impact the Nov. 5 general election. Judge Cox deemed the seven new rules for ballot counting, poll watcher access, and election certification as illegal and unconstitutional. This decision comes after a hearing on lawsuits challenging the rules, which were defended by a right-wing faction of the Georgia State Election Board and state and national Republican Party officials.
Critics of the now-scuttled rules argued that they would place unnecessary burdens on Georgia counties during a busy election season marked by record-breaking turnout. Judge Cox’s ruling invalidated rules such as requiring three poll workers to hand count every paper ballot and allowing local election board members to refuse to certify election results if they believed them to be inaccurate.
The ruling follows a similar decision by Superior Court Judge Robert McBurney, who temporarily blocked the hand count rule and mandated that county election board members must vote to certify election results. These rulings represent a significant setback for those who pushed for the controversial rules, including former President Donald Trump, who praised the State Election Board members responsible for them as “pitbulls for victory.”
