Former President Donald Trump has requested a New York court to delay his sentencing for 34 state felonies until after the November presidential election. Trump’s attorneys argue that the scheduled Sept. 18 sentencing date would overlap with early voting, giving him too little time to appeal a potential ruling against him. They also raised concerns about the integrity of the court due to the judge’s daughter’s ties to Democrats.
The attorneys also cited Trump’s presidential immunity argument as a reason for the sentencing to be postponed, as the Supreme Court recently ruled that presidents are entitled to broad criminal immunity for acts they take in office. Trump was convicted in May of falsified business records related to a payment made to adult film star Stormy Daniels in 2016.
Merchan initially set a July 11 sentencing date but agreed to delay it after the Supreme Court ruling. Trump’s attorneys argue that the prosecution included investigations into Oval Office meetings with his lawyer, which they believe could be impermissible under the Supreme Court’s standard.
The letter from Trump’s attorneys to the court raised concerns about how a sentencing could affect voter perception of Trump leading up to the election and proposed moving the date to mitigate concerns about the court’s integrity. The request for a delay comes amid ongoing discussion of the case on the campaign trail by Vice President Kamala Harris and Minnesota Gov. Tim Walz.
