Lawsuit filed in federal court challenges Georgia’s special campaign law favoring Kemp

Former State Senator Jen Jordan, the Democratic nominee for attorney general in 2022, has filed a federal lawsuit on behalf of the party against Georgia Governor Brian Kemp. The lawsuit challenges the use of unlimited contribution funds by Kemp and his leadership committee, which the Democratic Party argues gives him an unfair advantage in elections. The committee has raised approximately $100 million, largely from businesses with interests in legislation and state funding.

Jordan criticizes Kemp for using his committee to support or defeat Democratic lawmakers and candidates, violating campaign contribution limits that restrict such activities. The lawsuit alleges that the committee system favors political allies of the governor and other top leaders, while undermining challengers, critics, and the voting public.

Kemp, who is unable to run for a third term, may have future political aspirations such as a run for the U.S. Senate in 2026. Lt. Gov. Burt Jones, another politician allowed to raise unlimited funds through a leadership committee, is expected to run for governor in 2026.

Abrams and former U.S. Sen. David Perdue have also filed lawsuits challenging the use of leadership committees in Georgia politics, arguing that they provide an unfair advantage to incumbents. While candidates for statewide office face contribution limits, the law allows certain leaders to raise unlimited funds without restrictions, creating an uneven playing field in elections.
